Agreement to Terms and Conditions

Please carefully read the following terms and conditions relating to your participation in retreats, classes and programs (the “Retreat”) which is conducted by Siddhayatan Tirth (“the Organization”). By registering for the Retreat at any one of our locations (“Centers”), you (the “Attendee”) signify your acceptance of and obligation to these terms and conditions. If you have objections to the following Terms and Conditions, you should not register for or attend any Retreat.

Attendee Conduct

Organization requires all Attendees to be respectful and professional to our staff, location hosts, speakers, volunteers and other attendees and their guests or families throughout the Retreat, even during non-scheduled downtime and breaks. Organization reserves the right to ask Attendee and/or their guests to leave the Center immediately should they be deemed rude, uncooperative, unprofessional, intoxicated, or in possession of alcohol or any illegal substance. In such case, the Attendee’s tuition/fees for the Retreat will not be reimbursed under any circumstances and they will not receive any future products, services, or correspondence from the Organization. Attendee will also not receive any of our bonuses.

Attendee will also not receive any of our bonuses.

• Practice awareness to not kill or harm any living beings.
• Be watchful of your words – No abusive language at any time.
• Keep your body and mind pure – Alcohol, cigarettes, and illegal drugs (including prescribed marijuana) are strictly prohibited.
• Meat products are strictly prohibited on Siddhayatan property.
• Conduct yourself with good behavior.
• Never waste any food and ask only for what you will eat.
• Stress and negative thoughts are not welcome.
• Respect everyone and their opinions, beliefs, and culture.
• Leave your ego at the gate.
• Take your shoes off before entering any building.
• Practice cleanliness by keeping your room and bathroom clean.
• Practice compassion, awareness, and non-violence.
• Be watchful not to waste water, gas, and electricity.
• Follow all buildings, bedrooms, and bathrooms guidelines.
• Children must be supervised at all times.
• Psychic readings, tarot card readings, any similar readings are prohibited.
• Offering of massage, reflexology, or other type of services to guests are not allowed.

While we take every possible measure to ensure Attendee safety at the Retreats, we can not control everything. For this reason, Attendee is legally responsible for their safety and behavior and agrees to, and is held legally liable to, the following statements:

I, the willing Attendee of the Retreat, hereby accept all risks to my health and of my injury or death that may result from participating in the Retreat and I hereby release Siddhayatan, the Organization, Acharya Shree Yogeesh, Sadhvi Siddhali Shree, and their officers, employees, interns, contractors, volunteers, sponsors and representatives from any and all liability to me, my personal representatives, estate, heirs, next of kin, and assigns for any and all claims and causes of action for loss of or damage to my property and for any and all illness or injury to my person, including my death, that may result from or occur during my participation at the Retreat, whether caused by the negligence of the Organization, its governing board, officers, teachers, employees, or representatives, or otherwise. I further agree to indemnify and hold harmless the Organization, Acharya Shree Yogeesh, Sadhvi Siddhali Shree, and any third-party company from liability for the injury or death of any person(s) and damage to property that may result from my negligent or intentional act or omission while attending and participating in the Retreat. Under no circumstances will Organization or Acharya Shree Yogeesh or Sadhvi Siddhali Shree or their assigns be held liable for my injury or death or any loss or damage of my personal belongings resulting from my participation in the Retreat. Should I require emergency medical treatment as a result of an accident or illness arising during my attendance and participation in the Retreat, I consent to such treatment. I acknowledge and agree to be financially responsible for any medical or legal bills that may be incurred as a result of emergency medical treatment. I will notify the Organization verbally and in writing if I am at any time injured prior to, during, or after the Retreat in my travels or attendance, or if I have medical conditions about which emergency medical personnel should be informed; however, I understand that the Organization is not legally obligated to act on that information in any way or to provide any medical service whatsoever to me. I agree that if I have any medical or psychological conditions that may hamper me from fully and healthfully participating in the Retreat I will notify the Organization and that the Organization retains the right to ask that I not participate in portions of or the entirety of the Retreat.

Release of Liability

Assumption of Risk

I acknowledge that I have voluntarily enrolled to participate in this retreat. In consideration of The Organization allowing me to participate, I agree to this release of claims, waiver of liability and assumption of risks. On behalf of myself, my heirs, executors, successors, administrators and any other person who may have an interest at common law or by operation of statute, I hereby waive any and all claims I or such parties may have now or in the future. I release from liability The Organization and any teachers, employees, guides, agents or representatives for any personal injury, death, property damage or loss or any nature suffered by me as a result of participation in any activity on the retreat. I release from liability The Organization for any cause whatsoever including those arising out of, or in any way connected to or occasioned by the negligence of the representative, staff, volunteers, employees, etc.

No Professional Advice

The information contained in or made available by the Organization, Acharya Shree Yogeesh, Sadhvi Siddhali Shree, Sadhvi Anubhuti, or any third party through the Retreat or their websites or services cannot replace or substitute for the services of trained professionals in any field, including, but not limited to, mental, financial, medical, psychological, or legal fields. The Organization does not offer any professional personal, medical, financial, or legal advice and none of the information contained in the Retreat should be confused as such advice. Neither the Organization, Acharya Shree Yogeesh, Sadhvi Siddhali Shree, Sadhvi Anubhuti nor their assigns, sponsors, speakers, partners, volunteers, contractors, or any of their affiliates will be liable for any direct, indirect, consequential, special, exemplary, or other damages to the Attendee or the Attendee’s mental, financial, medical, psychological or legal that may result from participation in the Retreat or from the use of, or the inability to use, the materials, information, techniques, or strategies communicated through the Retreat or any products or services provided pursuant to the Retreat, even if advised of the possibility of such damages. Under no circumstances, including but not limited to negligence, will the Organization or Acharya Shree Yogeesh, Sadhvi Siddhali Shree, or Sadhvi Anubhuti be liable for any special or consequential damages that result from Attendee’s participation in the Retreat. To be clear: You, the Attendee, alone are responsible and accountable for your decisions, actions, and results in life, and by your participation in our Retreat, you agree not to attempt to hold us, the Organization, or Acharya Shree Yogeesh, Sadhvi Siddhali Shree or Sadhvi Anubhuti, liable for any decisions, actions or results that you make or experience in business or in life due to your participation in this Retreat at any time, under any circumstance.

Personal / Spiritual Growth

We’ve taken every effort to ensure we accurately represent this retreat and its potential to help you grow in all aspects of your life and spirituality. However, there is no guarantee that you will improve or grow. Nothing on this page is a promise or guarantee of growth. Your level of success in attaining similar results is dependent upon a number of factors including your skill, knowledge, ability, dedication, efforts, right conduct, and right vision. Because these factors differ according to individuals, we cannot guarantee your success in life or spiritually. You alone are responsible for your actions and results in life and business. Any forward-looking statements outlined here are simply our expectations or forecasts for future potential, and thus are not guarantees or promises for actual performance. These statements are simply our opinion. No guarantees are made that you will achieve any results from our ideas or models presented at the event, and we offer no professional legal or financial advice. Expressed Assumption of Risks

I, the undersigned, am aware that there are significant risks involved in water fasting, detoxing, and physical training, including but not limited to, the physical training inherent to all yoga exercise activities, and that my participation in any such fasting, detoxing, and/or physical training program carries with it the potential for death, injury, and/or property damage. The risks include, but are not limited to, falls which can result in serious injury or death; injury or death due to negligence on the part of myself, my training partner, or other people around me; injury or death due to improper use or failure of equipment; strains and sprains; those risks caused by terrain, facilities, temperature, weather, condition of athletes, equipment, vehicular traffic, actions of other people including, but not limited to, participants, volunteers, spectators, coaches, and trainers and lack of hydration. These risks are not only inherent to physical training and athletics, but are also present for volunteers and spectators. I am aware that any of these above mentioned risks may result in serious injury or death to myself and or my partner(s). I willingly assume full responsibility for the risks that I am exposing myself to and accept full responsibility for any injury or death that may result from participating, volunteering or watching in any fasting, detoxing, and physical training, including the retreat(s) I partake in. I realize that liability may arise from negligence or carelessness by the persons or entities being released, from dangerous or defective equipment or property owned, maintained or controlled by them or because of their possible liability without fault. I acknowledge that I have no physical impairments, injuries, medical condition, or illnesses that will endanger me or others.

I acknowledge that I am willingly participating in these activities and that I have assumed all risks as described above. In consideration for my being allowed to participate in the activities offered, I, the undersigned hereby release The Organization, their principals, teachers, agents, employees, and volunteers from any and all liability, claims, demands, actions or rights of action, which are related to, arise out of, or are in any way connected with my participation in this activity, including those allegedly attributed to the negligent acts or omissions of the above mentioned parties. This agreement shall be binding upon me, my successors, representatives, heirs, executors, assigns, or transferees. If any portion of this agreement is held invalid, I agree that the remainder of the agreement shall remain in full legal force and effect. If I am signing on behalf of a minor child, I also give full permission for any person connected with the hosting organization to administer first aid deemed necessary, and in case of serious illness or injury, I give permission to call for medical and or surgical care for the child and to transport the child to a medical facility deemed necessary for the well being of the child.

Indemnification: The participant recognizes that there is risk involved in the types of activities offered. Therefore the participant accepts financial responsibility for any injury that the participant may cause either to him/herself or to any other participant due to his/her negligence. Should the above mentioned parties, or anyone acting on their behalf, be required to incur attorney’s fees and costs to enforce this agreement, I agree to reimburse them for such fees and costs. I further agree to indemnify and hold harmless The Organization and the hosting organization, their principals, agents, employees, and volunteers from liability for the injury or death of any person(s) and damage to property that may result from my negligent or intentional act or omission while participating in activities offered. This includes but is not limited to parks, recreational areas, playgrounds, areas adjacent to main building, and/or any area selected for training.

Release and Waiver of Liability

I hereby agree that I, my assignees, heirs, distributees, guardians, and legal representatives will not make a claim against, sue or attach the property of The Organization, their affiliates, teachers, employees, agents or volunteers or any of their affiliated organizations for injury or damage resulting from acts, howsoever caused, by any employee, agent, or contractor, or any of their affiliated organizations, as a result of my participation in The Organization's retreats. I hereby release The Organization, and any of their agents or affiliated organizations from all actions, claims or demands that I, my assigns, heirs, distributees, guardians, and legal representatives now have or may hereafter have for injury, damage, or death resulting from my participation in The Organization's retreats.

I am medically, physically, emotionally and in all respects fit and able to participate in The Organization's retreats, programs, and services..

I agree I will be fully and financially responsible for my own physical condition and well-being during the retreat and will follow the safety precautions and instructions prescribed by The Organization.

I acknowledge that The Organization may make suggestions from time to time that are intended to help me and my well-being. However I take ultimate responsibility for my choices and realize that The Organization is not licensed medical provider and that I must consult my doctor.

If I experience pain or discomfort during the retreat, I will modify The Organization's instruction to suit my individual needs. I will not hold The Organization responsible for any pain or discomfort I experience during or after the retreat. I understand that the activities offered on this retreat, or in the programs and services, are not a substitute for medical care. I understand that The Organization is not qualified to perform spinal or skeletal adjustments, diagnose, prescribe, or treat physical or mental illness.

By agreeing to the terms outlined here and elsewhere on the The Organization's website I hereby release and discharge my rights and claims for damages or liabilities that may occur as a result of participation on a The Organization's retreats, programs, and services.

This Agreement shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of laws rules.

Confidentiality & Non-Compete

Attendee hereby understands that the tools, processes, strategies, materials, and information presented in the Retreat are confidential, copyrighted, and proprietary to the Organization and agrees not to record, duplicate, distribute, teach or train from the Retreat materials in any manner whatsoever without the express written permission of the Organization. Any unauthorized use or distribution of these proprietary concepts, materials, and intellectual property by you or your representatives is prohibited and the Organization will pursue legal action and full damages if these terms are violated in order to protect its rights.

Media Release

By participating in the Retreat, Attendee understands that portions of the Retreat’s live events may be recorded in video and audio and/or captured in still and/or digital photographs. Attendee agrees that the Organization and its assigns have the irrevocable right and permission to use such recordings and photographs should they include Attendee’s name, likeness, voice, biographical details, testimonial, or photograph for marketing, advertising, or any other purpose in any media or format, online and/or offline, now or hereafter without further compensation, permission, or notification to the Attendee. Attendee understands and agrees that all recordings from the Organization’s events are the exclusive rights of the Organization and Attendee does not ask for or expect compensation for the use of recordings or photographs in which Attendee appears or speaks. Organization owns all rights to any audio, video, and/or photograph captured during the Organization’s Retreat or at any of the Organization’s other live events. To protect our facilities, guests, and environment and ensure safety, security cameras are used throughout the premises.

Policies

Privacy Policy

By participating in the Retreat, Attendees acknowledge and agree that they are subject to the Privacy Policies of the Organization. The Privacy Policy for the Organization is listed at https://siddhayatan.org/privacy. Your personal information will be used only by Siddhayatan to contact you about your program or send you updates by mail or email, and will never be shared or rented to third parties.

Cancellation Policy

Once Attendee registers for the Retreat, we make extensive arrangements and investments while anticipating their tuition and attendance, and, in the case of their cancellation, we incur significant administration hassles and expenses. Given this fact, if Attendee does not cancel their reservation under the following guidelines they will incur a cancellation fee or forfeit the entire program fee.

• If you cancel your reservation within 24 hours of booking, you will receive a full refund minus a $50 processing fee per person, per room.
• If you cancel 14 days prior to your scheduled retreat, for any reason, you will receive a full refund less a $50 processing fee per person, per room.
• If you cancel between 7-13 days before your retreat, for any reason, you will incur a 50% cancellation fee, with remaining funds refunded to original payment per per person, per room.
• If you cancel between 3-6 days before your retreat, you will incur a 50% cancellation fee, with remaining funds held as a non-transferable credit only to be used towards a future reservation within one year of originally scheduled visit. There are no refunds.
• No credit or refund is available if you cancel within two days of program and on the scheduled day of arrival, for any reason. If you do not show up, if you forget, or if you leave your program early, for any reason, no credit or refund is available. No refund is available if you attend a program and are dissatisfied with its presentation or content.
• For Fasting Retreats, if you leave earlier than your intended stay, the remaining unused nights will remain as a non-transferable credit only, to be used within one year.

Siddhayatan reserves the right to cancel any program at any time. In the rare case of a Retreat cancellation, The Organization will offer a transfer to another retreat (if possible) or a full refund of your payment. The Organization is not responsible for any expenses or damages incurred as a result of retreat cancellation including preparation costs, airline tickets, travel documents or other expenses. The Organization reserves the right to cancel any retreat in the event that there are too few people booked, in which case you will be given a full refund of any and all payments made to The Organization. You will not be entitled to claim any additional amounts or seek any compensation for any injury, loss, expenses or damages (either direct or consequential) or for any loss of time or inconvenience which may result from such cancellation (including but not limited to visa, passport and vaccination charges, or departure, gear purchases, airport and airline taxes).

Registration Payment Policy

Full payment is required at the time of registration to secure the Attendee’s accommodations and program.

Rescheduling Policy

An Attendee may reschedule one time within one year of initial registration using their credit received based on the Cancellation Policy.

Siddhayatan Store Shipping / Refund Policy

Once the order has been successfully placed, we require 2-3 days of package preparation. Shipment if within the US should arrive in less than 5-7 days. International orders may take up to 6 weeks; however, most arrive within 10-14 days. There are no refunds for opened and used products. If the product is unused, please return back to us to receive refund minus shipping costs. Buyer pays return shipping. If the product is damaged upon arrival due to shipping, please inform us at info@siddhayatan.org and we will send out the replacement item.

Siddhayatan E-Certificates / Refund Policy

• E-certificates can be used within ONE year of purchase before the expiration date, with no exceptions.

• Certificates are transferable but NON-refundable, with no exceptions.

• You can schedule your retreat based on availability found on our calendar.

Review and Jurisdiction

These Terms will be governed by and construed in accordance with the laws of the State of Texas. Attendee agrees that any dispute that arises out of or relates to these Terms will be resolved via non-binding mediation in the State of Texas via a professional mediator obtained by the Organization and if a successful mediation is not reached, to binding arbitration arbitrated in the State of Texas in accordance with the policies set forth by the American Arbitration Association. If any of these Terms of use are found unlawful, void, or for any reason unenforceable, then that provision will be considered severable from the remaining terms of use, and will not affect the validity and enforceability of the remaining provisions.
